I know nothing about criminal law, but the slide said 3.5 years was the longest minimum allowed, implying that you could have a much shorter minimum sentence. Honestly, I'm thinking that there is at least a good chance that she may not get any jail time if part of the sentence is a requirement that she make restitution.
All I can say is this: they may promise to make restitution, but collecting it might be a different story.

Sentencing day is TODAY. There were questions two weeks ago about whether to hold a restitution hearing the same day of the sentencing and the judge said YEP. Not only does it appear she'll have to cool her heels for a few months behind bars, but she'll have to repay about $90,000 plus. sounds like it's going to be a heck of a day in Erie. Happy travels!!!!
And he didn't seem to have a care in the world last evening at the Debate ... oh that's right ... he's not the one who ripped off the estate ... and he's not the one who is going to jail ... he's not the one who is responsible to pay back $90.000 and he's not the one who is going to get a $15,000 fine ... so he does not have a care in the world.
But I would bet that he is the one who helped spend that money ....

Well ... I was wondering if Joey had anything to say about this situation ... Joanne knew her fate early in the day ... Joe made other posts ... and said nothing about this ... what did he have to sit and think about how he could spin this to make it look like they are the victims here ... how rediculous ... anyway the idiot finally addresses his wifes problems.
Erie judge throws the book, I mean, the whole library at Joanne - 7 year prison sentence 2 - 7 years in prison and a $15,000.00 fine. And, on top of that, post $10,000.00 in cash while out on appeal. She had been free on her own recognizance. That's the sentence for a first degree felony, much like the judges in Luzurne County who got a similar sentence. A judge's wife in Bradford ripped off $550,000.00 two years ago and got a six months probation sentence. It's not just an outrage, it historical. We can't file the appeal fast enough. You'd think they'd have been happy with a fixed trial where lawyer Chris Cullen was a no show. Not at all. They were hungry for more.
Joanne was charged at the lowest level of felony, a third degree. The sentencing guildeline for a third degree felony with no priors and no aggravating circumstances is 9 months maximum to make restitution, if there is any. She has no priors and no aggravating circumstances (other than being my wife) were involved, like the use of a weapon or threats, etc. The judge however, created some circumstances as he saw fit. It should have been in and out at that. But, the AG's Office and the judge had something different on their minds.
She is, after all, the wife of Joe Pilchesky. She has to pay and let Joe Pilchesky fix it in the appellate system. Meanwhile - suffer. The judge gave her the maximum possible sentence for a first degree felony conviction, something she wasn't even charged with.
In a document provided to this judge last week, Judge John Garhart, titled a Motion to Delay Sentencing, the court was put on notice that there was a serious jurisdiction problem that will leave the court with no victim. So serious, it would unquestionably end the case. It related to the fact that the woman who filed the bullsh!t charges, Charlene Snyder, had illegally and unlawfully acquired letters testamentary and was equally illegally and unlawfully appointed Executrix, with the aid of her lawyer, Atty. Ralph Riehl of Erie, and a crony Register of Wills. Translated: as a matter of law, there was never a victim in the first place and the verdict has to be vacated/voided/reversed. The game is over. That's not what this judge wanted to hear, I'm sure. The purpose of the motion was to just inform the court that very shortly the Executrix is going to be exposed as a fraud, as well as her lawyer, and the corrupt Register of Wills won't be looking so rosey, either. Therefore, sentencing would be a waste of time and resources. Without saying, the judge immediately denied the motion, which we didn't expect. The handwriting is on the wall here, the victim was a total fraud from day one, something the AG knew, but proceeded nonetheless.
In addition to that, Judge Garhart was informed that this Friday at 9:30 am there is going to be argument relating to voiding the probate and letters testamentary and as a matter of law, when the dust clears, the victim was going to disappear from this case. You'd think that would have been enough for any judge to cool his jets on sentencing and await the outcome of that argument. Not Judge Garhart. He had been busy grinding his axe for Joanne's neck and it wasn't going to be for nothing. The AG's Office wanted blood. All this wasn't going to be for nothing, although, in time it most certainly will be.
So, we are again complimented with this showing of incredible fear for what we do. What do they fear so much in the first place? We're only two people who expose corrupt politicians, gov't employees and contributors ranging from the Mitchells of the world to judges worthy of a good ass kicking. We take the government to court once in a while and munch on their fat, crony asses. What can we say, it's not only good eating, but it's tasty. Today, however, our asses were on the menu. We'll give that little snack. We'll assign it to the continuing development of our purposes. I say good job to the AG's Office, Andy Jarbola, the political machine here and in Erie, the judiciary and Atty. Chris Cullen. It was a job well done. A tip of the hat to all of them. But, if that's all they've got........................
Well, let's just say they'll need a lot more than that to shut the Pilcheskys down, a lot more. And people ask what motivates us? This stuff motivates us. And, I couldn't be happier about it.

Dead dad swindled Scranton woman sent to prison for theft from estate By Lisa Thompson lisa.thompson@timesnews.com A Scranton woman was sentenced Tuesday in Erie County Court to 25 months to seven years in state prison for draining more than $150,000 from the estate of her father, an Erie resident, in the hours and weeks after he died.
Joanne Pilchesky, 56, must also pay $146,500 in restitution to the estate of her father, Raymond Conrad, who was 82 when he died, and $6,255 to a bank that held some of her father's funds.
The bank, PNC, had paid Pilchesky $6,255 from Conrad's estate after his death in September 2005, but then reimbursed the Conrad estate once it realized the disbursement was not proper.
The sentence, which fell in the most severe recommended by state sentencing guidelines, came after an Erie County jury convicted Pilchesky of one third-degree felony count of theft on March 18.
Conrad had named his niece, Charlene Snyder, not Pilchesky, executor of his estate. The jury found that before Conrad's will could be probated, Pilchesky, who had been named an heir in the will, used an existing power of attorney to transfer nearly all his liquid assets to herself.
Judge John Garhart, who sentenced Pilchesky, also fined her $15,000, the maximum in the case.
Garhart acknowledged that Pilchesky had no prior criminal record, but said the evidence showed a signed copy of Conrad's will had been removed just before or at the time of his death, "never to be seen again."
He said Pilchesky improperly used the existing power of attorney for her father's affairs to begin transferring money from her father's accounts to herself within minutes of his death. The evidence showed she then drafted a "spurious" will to cover up the crime, Garhart said.
Garhart also faulted Pilchesky for showing no remorse. He said she continues to use "vexatious litigation" to harass "all who would call her to account."
Pilchesky, an activist known in her home area for maintaining a comment board critical of Lackawanna County politicians, represented herself at the hearing.
She asked the judge to wait to determine restitution until the legal dispute over Conrad's will and estate is settled in Erie County Orphans' Court.
Testimony indicated Pilchesky was in line to receive approximately 70 percent of her father's estate. She argued Tuesday that she might owe as little as $20,000 to the estate once it is inventoried.
Garhart rejected that argument. He entered a $146,500 judgment in favor of the estate, which he said should be filed in both the criminal case and the Orphans' Court litigation over Conrad's estate.
The state Attorney General's Office handled the case after the Lackawanna County District Attorney's Office referred it to state prosecutors in 2006, citing the case's complicated nature. A statewide grand jury recommended charges, which were filed in October 2007.
Nils Fredericksen, a spokesman for the Attorney General's Office, said the case sends a message about the importance of obeying the law in estate cases. "You can't clean out a bank account, you can't take what you think you are entitled to," he said.

Joe Pilchesky's ego will not allow him to see that he's simply not important enough to warrant a cross-state conspiracy. The facts are pretty simply here, and if the Judge was on the harsh side, it's because it's very clear that no remose has been shown AND Pilchesky has stalled, aovided, and done everything possible to make this process go on forever.
Look for a post sprinkled with tears from Foam'n Fay...in the Pilchesky duo she found the only other two humans who could tolerate her serial-nastiness.

Joann did rob the estate ... I check this site out every once in a while, mainly for the Joanne update. So I am here right now to just let everyone know how ****ing happy I am about this sentence. I am a firm believer in karma, and I believe that this could not have happened to a more deserving person/people.
In a way this is nothing to be happy about: an old man suddenly got some attention from one of his daughters as he was dying...and we later discover that it seems this attention had more to do with greed for money than compassion for the dying. I can think of fewer things that could be more cruel or sad...forgetting illegal for a moment.
Yes, there is a certain satisfaction whenever a bully gets knocked down a peg or three, but it's a shame that the take-down had to come at the expense of an old dying man. If there is an after-life, I have to believe that Joanne Ricci Pilchesky will not find it to be a very pleasant place.

No Penelope I do not think that we will ever be that lucky ... Joe will stay right here and make the occasional trip to Erie to visit Joanne ... but he didn't feel it necessary to stay home with her to maybe comfort her ... hold her hand ... reassure her that everything would be alright ... the night before the sentencing ... he went to the DEBATE ... that was more important to him than Joanne is.
