Well, Joe and Joanne said they were never informed of the hearing so ... damn it it must be true that they were hoodwinked by the evil Register of Wills in Erie.  All it took for county mounty (aka Joe Pilchesky) was for Joe to supply the transcripts of the hearing ... take a look!

Mr. Pilchesky, beyond your wife's constitutional right to due process being violated by the Erie County Register of Wills by his the failure of notice to her that a hearing was going to be conducted complete with witnesses, I'd have to wonder if she was properly served with the petition.  That's original process that requires service by the Sheriff's Office, just in case that was not done.  Furthmore, denial of legal counsel where a party is demanding an opportunity to get counsel is another severe abuse of due process rights. Joanne's request for a continuance should have been granted.  They could have held the hearing two weeks later to no one's harm. What was the rush?  They saw an opening to illegally open an estate and the Register of Wills played right along. His office should be investigated. How many times has he done that to others who don't fight back as you are?

Another thing, even more vital, if that's the procedure they used to open the estate, it was defective from beginning to end, especially considering they were intending to probate an unsigned and unexecuted Last Will.  Direct your attention to jurisdiction of the Register of Wills.  It can only be invoked with a properly executed Will.  Period. 

Good luck, it appears you'll need it.

Now call me silly if you want ... but how do we know that Joanne was never told about the hearing ... all I have is the word of Joe ... and I tell you what that does not mean much to me ... as I am not one of his cult members!

Now let me see, there is one "real" lawyer who regularly posts at DD, but yet he hasn't commented on the whole "evil Doherty and cohorts are throwing my wife in jail" yarn.  Gee I wonder why????

Oh, and given Pilchesky's record of suing absolutely everyone he comes in contact with, I'm thinking that I woudn't so much as sell the guy a loaf of bread without some legal indemnification first.

Have any of you read the transcripts?

Now if I am getting this right ... (I read some this morning not all) Joanne claims that she had the original will ... she claims that there is another will ... but she never produced it ... Why? If there was another will why not bring the original along with the new will ... I don't get it ... but what I really don't get is why are the sheep falling for this ... it's pretty clear cut if you ask me ... but I'm not a lawyer (or am I?) ... Joanne was presented with the opportunity to offer up the will in question (the original) she held up the process by not providing the Register of Wills a copy of ANY will ... she could have presented both copies and requested a hearing ... but she made a choice not to ... Life is all about choices ... some of us choose to live a good live free of crime ... and then there are the Pilchesky's ... they get everything they deserve ... I just can't believe that nobody is calling him out on these transcripts ... it does not make her look innocent ... I and it is only my personal opinion ... think this makes her look guilty as sin!

Joe, there are a few lawyers who'd like to look at the petition that was filed by the woman who eventually became the executirix of your wife's father's estate.  They'd like to help, so if you can post it and any related documents you might get a tidbit of information that could help your wife in this screwing of a lifetime. 

My heart goes out to you guys, but at the same time I'm thrilled that you didn't fold.





Correct me if I'm wrong, but isn't there ALWAYS a "I've talked to some lawyers who want to help you" post after EVERY Pilchesky courtoom meltdown?

In retrospect, it was probably marrying Joe....although you do have to wonder what kind of person would steal from the estate of their dead father, especially given that she was slated to receive a large amount of money to begin with.

Ya know, I found it mighty amusing trying to reconcile the "I didn't know" with all his otherwise high-falutin', self-masturbatory talk of how he's always outwitting everyone on the legal front (though reality of his actual win record doesn't check with this).

Meanwhile, it seems to me they DID request continuance after continuance, so they knew all this was heading down the pike at them from a long way off. So no excuses.

I also found it amusing to see that he held up scans of the various briefs that he was buried under while Joann's case came up. Self-inflicted burial under other cases, so sorry, Joe - no sympathy there either. In effect, it looks like Joe threw his own wife under the bus for sake of his own self-aggrandizing legal battles.

With regard to Cullen, who knows. Seems to me that he got Cullen's help in exchange for doing hatchet work against Shimkus on Murphy's behalf. And he's also doing hatchet work on DiBileo's behalf as well (and Cullen is working for DiBileo too). Seems to me that Murphy and/or DiBileo would have more of something to do with burning Joe than anything else.

But who am I to say...

 Don't you know?  Marrying Dave wasn't our Jan's fault.  She had been sick & was on meds which made her fuzzy headed.  Says she doesn't even remember getting married.
Why has she stayed?  Because if she divorced him, people would talk.  Oh, yeah, she's afraid of him.  They stayed together for the kids.  She's Catholic. If she's going to be in politics, she can't be divorced. Pick one.  None of it is her responsibility.

I don't know the details about the marriage of David & Janet Evans nor do I ever want to know the details about the marriage of David & Janet Evans.  I will say this though:  it's 2009, not 1959 (despite what the city Democratic committee would have you think), so I'd think that if either one of them wanted a divorce they would in fact be divorced.  The notion that she would remain married for sake of politics seems like a stretch to me anyway...besides, her political ladder doesn't seem to reach much beyond city council.

Ag, I didn't say she made sense, that is just one of her myriad reasons for staying married to Dave even though he cheats & beats & god knows what else.  See, it's not anything under her control. 

As for her political ladder, don't walk under it.  She's going to try again for higher office. 

Ihavehadenough--glad you got a laugh out of the image of Jan bench pressing Dave.  But she still sees herself as the frail waif she was when she was barfing full time.

LOL You think he cheats?  I said this once a long time ago. I have a hard time figuring out how he got one person to pay any attention to him never mind two....ewwwwwww. 

Missy Jan may still be rolling out those old BS lines but believe me she doesn't believe them now anymore than when she was saying them back in the day.   She is, in my opinion, a mean, crazy, self centered, manipulative, and lying individual.  She uses Dave as her excuse to get what she wants done; he is basically her attack dog.  She also has Fay for that as well.   If she really decides she wants higher office and someone whom has credibility in her eyes shows her Dave is between her and that objective (and he will be an impediment) she will dump him in a New York minute.  I wonder if he knows that yet. A frail waif?  Yes she probably does try to sell that image god love her.  She hasn't been frail, I don't imagine, since she was what....5 maybe?
