Pilchesky brought the original suit against Council President Gatelli. She countersued. They should be kept seperated while she is doing city business. As long as the "hundred or so Scranton Tax-Payers" remain "anonymous", city business can't very well be halted (as if slowing down progress any more would even be noticable...) just because one of the speakers may be John Doe #56 or whatever. Your twisting of the logic doesn't work here. Pilchesky hasn't appeared at council lately, as far as I know, and defendants Doe #1-100 are still technically unknown. Therefore, I've only said the Pilchesky's shouldn't be allowed in chambers, to this point.
If I sued you for whatever reason, do you really think it's a good idea for me to knowingly appear at your place of work week in and week out, harping on the reasoning for my lawsuit? That probably borders on harassment.
Paul...I'm not twisting anything here, as a matter of fact, I'm kind of agreeing with you. Again, I don't think Council Chambers is the time or place for those arguments, that's what a Courtroom is for, that's what I'm waiting for, seeing how I'm named in the suit. Banning anyone from chambers is unconstitutional, if anyone brings up the topic of the suit at a meeting, they should be instructed that it's under litigation and cannot be talked about, if they continue they should be gaveled out of order and asked to step down, but there is no reason to ban anybody.

Well Clarence got a draw on his website lawsuit so he is now 1 win 1 draw for 30 lol. I wonder why he gave up? He is awfully subdued for someone who just stuck it to the PSP and DA's office. Maybe that "victory" came with some conditions which could be very easily violated on his part, nullifying the agreement? Sounds like maybe the big dog, while not necessarily being chained to the porch, was fitted with a shock collar.

Nope... I don't think it was a settlement that favored him, his ego wouldn't allow him to not at least to throw out a crumb of info, no I suspect the settlement was not at all to his liking.

Why not go through the case? What happened? Settlements occur only when the outcome of the court case is uncertain, or when the cost of the litigation is more than the compensation of the successful outcome, or perhaps when the party realizes they may have to divulge information they prefer to keep private and so on. So since Joey was fighting for the people, for their right to viciously attack others simply for the sake of the pleasure they get in doing it, we know it wasnt about compensation right?So what really happened?
Dont be naive Deleware; unless, of course, you believe Joey just wanted to help out the DA and PSP and laid down for them, he must have got something out of the settlement! What exactly he got (or what exactly it would have cost him if he didnt settle) is unknown for the moment. but in time information will come out, it always does eventually! Joe reminds of this kid in my neighborhood when I was growing up. The kid would pick fights with everyone, everyday. He would then proceed to get pounded to a pulp every time by every other kid. Never won a fight. Funny thing is he always bragged about how many fights he picked and how no one ever knocked him out. Glass half full guy I guess, just like Joe.

No money because they weren't actually the ones who shut your site down. True of false?
I've heard from a very reliable source that in addition to the strongly worded statement from the Pennsylvania State Police, serial-plaintiff Pilchesky is also to be given a coupon entitling him to a free regular sized frozen treat at either the Scranton or Dunmore locations of Rita's Italian Ice. No word on whether or not the coupon has an expiration date.

RE: Pilcheskys win lawsuit against State Police No shoes for baby, at least not here. That 50K went to the lawyers. They earned every penny of it. The paperwork was four feet off the floor. The DA agreed to the policy terms but was adamant, NO MONEY FOR THE PILCHESKYS. We could have dragged them through the process and put them in front of a jury, but their culpability was limited and we wanted closure on the policy language as soon as possible for the obvious reasons. The lawyers got paid, we got an injunction and precedent at law, and we also have protection that when we click on the message board, we won't find it gone with its valuable cargo. The non-ACLU lawyers, from what I understand, donated all of their fees to the ACLU.
So what can we learn from this? How about...
...contrary to what 'The Shed' said, it was only $50k ...that didn't go to Pilchesky ...that instead went to the lawyers...why? because they did the actual work...so much for Pilchesky winning.
The bottom line is this: Pilcheksy and his thugs screwed up last year with the Hailstone postings, but the Pennsylvania State Police screwed up too by failing to play by the rules. Of course Pilchesky didn't want this to go to trial, as it would would dredge out all of the scum that inhabits the DD site. In a the mind of many jurors, rabid, hate-filled rumor mongering would probably be viewed as being worse than a procedureal screw-up on the part of the Pennsylvania State Police. So what does the bald, bitter one do? He get's the ACLU to help (I have mixed feelings about the ACLU...but that's another thread), and, as they are real lawyers, and they negotiate a settlement for him that makes this go away.
Pilchesky should enjoy the ^5s from his zombies and the free coupon from Rita's, as that's all he really gets out of this whole situation.
