I spent some time with residents of this area this afternoon and I'm satisfied that with the facts that they shared with me will support reversing the sale of this public park.
1. It's been a dedicated public park for 35 years;
2. It has been improved by the City of Carbondale with a playground, basketball courts, sliding board and swings, all paid for with local, state and federal funds.
3. The City of Carbondale maintained this public park for the last 35 years, cutting the grass and doing other maintenance.
4. The park was never abandoned by the locals. They used it up to the day the new owner posted it as private property.
5. The Donated and Dedicated Property Act of 1959 prohibits the sale of this property unless it was abandoned by the public, fallen into disrepair and presented to an Orphans Court judge as abandoned.
6. The property was donated for use as a public park.
A complaint will be filed on Monday. The fat lady hasn't sung yet.
