Below are copies of lawsuits that I've prepared and forwarded to DA Jarbola for prosecution. They're called Quo Warranto actions. That aspect of the law relates solely to removing officers from office, whether elected or appointed. The procedure requires that I must first request that Jarbola prosecute them. If he declines, then I automatically have standing to prosecute them myself, but I'd have to change the nature of the action from one of Quo Warranto to that of an action in Equity. Learned that through the tennis match-style struggle with trying to get McDowell removed from office, meaning back and forth on appeals, etc.
In these cases, all three appointments went before council, and all three were rejected by council. Thereafter, all thee nonetheless took a seat on the respective authority, a middle-finger gesture from the mayor to the people. I don't expect the DA to do his job in this regard. He's repeatedly refused in the past. We'll see what happens in these cases.
Because first, Council really has no say in it. The appointments are the Mayor's to make, and Council "approval" is merely a courtesy not a requirement.
Secondly, Council's lawer appears to be on his way out, and has given shaky (at best) legal opinions thus far. He's not relaly the one who should be pursuing the cases. He's stayed out of them so far, why get involved now?
Finally, a day without a soon to be bounced frivolous Pilchesky lawsuit is like a day without sunshine.
