I was driving home from work today when I received a call .... very reliable source who asked to remain un named ....
Seems as though our favorite web host Joe Pilchesky has not paid his property or garbage taxes since 2003 and owes more than $8,000 ... Now the property is in the name of his wife Joanne Ricci ... but Joe and Joanne own the property ... and Joe and Joanne own the website.
So now we have a man who claims to be exercising his rights as a taxpayer ... suing the city costing them 42 THOUSAND DOLLARS ... owing more than $8,000 in property and garbage taxes ... HE IS NOT A TAXPAYER! You sir are not a taxpayer ... only someone who costs the taxpayer money. Maybe if you stop your frivilous lawsuits and pay your taxes it will help contribute to the solvency of the city and enable the administration to maybe put it toward the contracts that remain unsettled!
No wonder he is so opposed to those NCC fees ... can you imagine what they must be for a guy who hasn't paid taxes in 6 YEARS.
How about you just pay your taxes and stay out of court Joe! Can you say Sheriffs Sale?????

I received a call from someone ... and they asked me not to mention their name ... so I didn't ... I found it very interesting that someone who costs the city thousands in legal fees ... does not pay their taxes ... shame on me for putting it up. And I have to give you credit for being loyal to your mentor in political activisim (I gagged when I wrote that) .... way to try and change a subject.

But what really nags at me is the fact that there are starving children in the world ... that there is so much hate in this world ... the fact that our babies are off fighting wars ... and that's just to name a few things! The worry that the cancer I once had will return ... now that one really nags at me.
There are so many more important things in the world so don't get hung up on a screen name ....
Oh and Lus is for my favorite Aunt ... Lucianne ... we always called her Lus ... she passed away 5 years ago now ... she was my very last living Aunt ... so I thought I would honor her by using her name for something that she would believe in ... hope that helps you to sleep at night Glenn.

Well it appears, Joe and Edith haven't filed their Federal Income Tax from 1999-2007. And what does somelike Joe do when the IRS comes knocking? Well of course he sues them.

Background
On April 14, 2008, Petitioners initiated this action with the filing of a Petition to Quash Third Party Summonses (Doc. 1) issued by the Internal Revenue Service (IRS). Petitioners are proceeding pro se.
On July 23, 2007, Respondents filed a Motion to Dismiss for Lack of Jurisdiction (Doc. 5) and supporting brief (Doc. 6). Therein, Respondents argue that third-parties Wachovia Bank, N.A. and Community Bank, N.A. & First Liberty Bank Trust are not found within this judicial district and, accordingly, that this Court is without the subject matter jurisdiction to quash the summonses issued to these two (2) third-parties.
Also on July 23, 2007, Respondents filed a Motion to Enforce IRS summons (Doc. 7). In this motion, the Respondents argue that Petitioners have failed to allege the grounds require to quash the summonses issued to four (4) third parties, including NBT Bank, N.A., Wachovia Bank, N.A., Community Bank, N.A. & First Liberty Bank Trust, and Citizens & Northern Bank. Along with the motion, Respondents submitted the Declaration of Sidney Burnside (Burnside Decl., Doc. 7, Ex. 1.) which details the nature and history of the IRS investigation into Petitioners tax liabilities from 1999 through 2007.
Petitioners filed a Motion for Extension of Time to File Briefs (Doc. 9) in reply to Respondents' motions on August 15, 2008. The Court denied Petitioners' Motion in an Order signed August 27, 2008. As Petitioners failed to timely file briefs in reply to Respondents' motions and were unable to obtain an extension of time, Petitioners' and Respondents' motions are currently ripe for disposition.
In this case, the IRS has submitted a declaration from Revenue Officer Sidney Burnside stating that: (i) he is examining the Petitioners' tax liability for the years 1999 through 2007 because the Petitioners have not filed tax returns for those years, (ii) the summonses issued in this matter are relevant to the IRS investigation as the information sought is needed to determine the correct amount of Petitioners' tax liability for these years, (iii) the information sought is not currently in the possession of the IRS, and (iv) the IRS followed all administrative steps provided by the Internal Revenue Code when issuing the summonses. (Burnside Decl., Doc. 7, Ex. 2.) This declaration satisfies the required burden for a prima facie case as established in Powell.
Officer Burnside further represents to the Court that the pending investigation has not been referred to the Department of Justice and the IRS has made no recommendation to the DOJ for either a grand jury investigation or any criminal proceeding against Petitioners for the years under investigation. Officer Burnside further states that the IRS is not delaying such a recommendation to the DOJ and the DOJ has made no request pursuant to 26 U.S.C. 6103(h)(3)(B) for the disclosure of any return or return information relating to Petitioners. (Burnside Decl. 18.) Accordingly, the IRS is not attempting to circumvent constitutional limitation on the collection of information during a pending criminal prosecution.
CONCLUSION
For the reasons stated above, the Court will (i) deny Petitioners Joanne Ricci Pilchesky and Joseph Pilchesky's Petition to Quash Third Party Summons (Doc. 1), (ii) deny Respondents' Motion to Dismiss for Lack of Subject Matter Jurisdiction (Doc. 5), and (iii) grant Respondents' Motion for Summary Enforcement of Summons (Doc. 7).

The man is a moron. Make that an f-ing moron. There are some things in the world you do not ever mess with...and the IRS should be at the top of the list. Refuse fees unpaid for 819 Sunset; Assessed Owner: Joanne R. Ricci
Years 2003 - 2008 ($178.00 + Penalties) 1,087.69 Fees incurred: $271.92 Grand total Delinquent Due $1359.61 (Refuse) Due April 30, 2009
In 2005 it appears that a payment of $199.36 was made In 2006 it appears that a payment of $180.56 was made
The total payment due in 2003 was $199.36 so it appears that in 2005 a refuse bill for 2003 was finally paid, and then in 2006 a partial payment was made and I cannot determine which year that might be for.
The way this guy rides the DPW workers one would think that he was paying his refuse Bill, now I know what you are all thinking ... he already pays property taxes so that should cover his refuse ... I hear it all of the time ... and I might say ok ... you got me on that one ... however .... as it appears ... the taxes on the property have not been paid sooooooooooooooooooooooooooooooo.
for the years 1993 - 2007 a delinquent tax search was performed and well .........
Total tax due: $5,160.13 Legal fees: $1,559.00
Total Delinquent owed in Property taxes: $6,719.13
Grand Total owed to the city (mind you this is absent of the School and County Taxes)
$8,078.74
Now I can only imagine what the total bill is considering that the School District gets the biggest chunk out of the taxes. Hmmmmmmmmm .... yeah I trust this guy ... he's real honest ... and he would never call others out on what he himself is guilty of. WOW!
(The above figures reflect Penalties and Fees, had they apid thier taxes in the years 2002-2006 it would have been $496.31 a year and in the year 2007 after reassessment it went up to $623.37)
Now when you compare the taxes on the property 819 Sunset I would have to say for the area they are paying quite a low tax ... when compared to the other properties ... and he has the nerve to bitch about what taxes cost the average Joe .... )

I do believe that if the refuse fee goes unpaid that the city is not required to haul your refuse away ... you will have to hire a private hauler ... so in the wind will be the stench of Joe's rotting garbage ... because if you don't pay the private hauler ... hell they don't take your garbage!

What State Rep. Murphy is trying to accomplish here is passing a state law with some teeth to it that would make it impossible for the county commissioners, or any other taxing body, to arbitrarily raise our taxesin excessive amounts without the voters agreeing to it. If a tax was needed above 5% or so, it would go on the ballot, where it belongs. It's called a referendum. The people decide. You know, the ones who pay the bills around here.(Joe would that mean that you don't get a say?? As you don't pay your taxes that means you don't pay the bills)It's a great effort by Rep. Murphy to put people like Doherty on a leash.
Here's a copy of the proposal mailed to all of the communities in Lackawanna County wherein the legislation is fully explained. Every local taxing body got a copy. Attached to it was a Motion that any of the taxing bodies could sign and return as a sign of support of the new law.
Gatelli and Fanucci, along with McGoff, voted against this legislation.
Why?
It will protect us from further taxation like the 48% tax hike Cordaro hit us with and the 25% tax hike Doherty just hit us with.(No Joe it is designed to protect those of us who actually do pay our taxes not people like you who do not pay taxes. I have to wonder if you would be in favor of this if it protected those who do pay and levied stiff fines on people like you who do not pay ... what would you think about it then?)
In fact, the mayor has stayed silent on the issue, electing not to show any support for the legislation.
My source has informed me that Doherty placed calls thoughout the community looking for support against this important law. (Ok ... so now you have just contradicted yourself ... The Mayor has either stayed silent or he has been placing calls ... make up your mind ... you can't tell me one thing and have me believe another ... I'm not one of your sheep!) Gatelli asked her friends in the Taylor/Old Forge area not to support it. Strange that a public official would vote against protection we need. Fanucci to piss all over me in Times-Tribune story - I'm a hypocrit, don't you know? I got a call today from our esteemed Stacy Brown/write-a-like Jeremy Burton today explaining to me that our more esteemed councilwoman Sherry Nealon Skettino Fanucci Doherty believes me to be a hypocrit because I demand higher standards from our elected officials, but my wife appears to be behind on property taxes for 819 Sunset St., so I don't have a right to demand higher standards from our public officials. In other words, I have no right to speak. If that makes any sense at all.

NCC claims there is about $7,000.00 due and owing on 819 Sunset St. dating back to 2002. NCC has been asked to produce the backup on that claim. It has failed to do so. I tell NCC to go fvck itself until it can prove the taxes are not paid. We have receipts showing 819 is current through 2007. It does nothing in response. Why not? Why isn't NCC dragging me into court or putting this house on the tax sale list? If the taxes really aren't paid, then it's their job to collect them. What's the hold up?
Where's the mayor when you need him? C'mon Doherty, collect the taxes already. You're the chief, the boss, the head honcho, the main man and the guy with the ultimate hammer. Use it. Bashful? Or, is it that NCC can't get the job done?
