What happened at the trial Joe?
Not allowed to sit "up there" if you aren't an attorney....

Maybe he should dedicate some of his time working towards being an actual attorney rather than just thinking he is one.

I thought Sam said he was defending HIMSELF.

Seems to me that Mr Pilchesky was going to "defend him".

Signage...please, favor us with a full report. As of a moment ago, there was no posting on the "trial" on DD.

I'm just waiting for that OhNo moment...you know, when then they show the videotape and Sammy sees the look on the face of the judge (is there even a jury for this?) and says "Oh no, my hecky-shecky a$$ is screwed".

Oh, and for someone who writes with such distain for local lawyers, the serial-plaintiff sure does like to pretend to be one.

My understanding is that despite all the buildup and rhetoric from Sam's mouth, he wound up copping a plea and accepting ARD.

No federal lawsuits here, folks. Hard to file the lawsuit when you plea out on what you're suing Council for.

The Affidavit of probable cause seems to be pretty thin to me. How do they intend to show an intent to obstruct a scheduled council meeting and he signed up as a speaker, especially considering the fact that the **** didn't hit the fan until Gatelli interrupted?

LoDer Bill on WILK now...confirms that Patilla is under the ARD program...but claims that he "won". Funny, but if he "won", then why did he go into ARD? Cobett is calling Bill out on the fact that going into ARD isn't the same as being innocent.

Well I'm not quite sure who WIZZY is so I can't tell if he/she was there.

I guess my idea of FREE ON ALL CHARGES is different to the DD posters, because a PLEA doesn't mean FREEE ON ALL CHARGES.
Seems to me he knew his ass was in a bind and took the easy way out.

Guess we don't have to worry about them renaming his street anytime soon. LOL LOL ROTFL

He came off that elevator as if Janet herself was his stylist. Fancy suit and that friggin white band around his head. Classy, Sam -- real classy.

I've never heard of a true activist, one who felt he was in the right no matter what, plea bargain liek that.

Sammy just grabbed his ankles, plain and simple. He might as well have just said "Yes, massuh, whatever you say, massuh" the way he set his cause back. He totally rolled over on this one.

Today Sam plead guilty to disrupting a meeting and other charges. The judge wanted him to get a lawyer which he would not anyway......pleading guilty and getting the ARD program DOES NOT mean you "were freed of all charges"......below Foamin, teethless Fay writes garbage....read the paper tomorrow Foamer.

Here are the best parts.

1. He plea bargained.
2. He cannot appeal.
3. There is no blaming a "crony judge" when a defendant cops a plea.

Sammy took away two of Joe's favorite whining points.

I'll wager that Sam's posting days are very limited now. I also don't think we'll be seeing him at the podium anytime soon.

My information is that Judge Gerulo was impressed with Sam's conduct in the courtroom and agreed to hold off on the prosecution of the charges for a period of 3 months if Sam can conduct himself at council meetings the way he conducted himself in court, at which time, the charges would be dropped and/or expunged. This is a nice victory for Sam, who is the clear victim in this matter all the way. The way for the city to avoid a prosecutorial misconduct case is to do exactly what happened today. Sam backed them down. And, without a lawyer. That's been going around. Dan Hubbard recently filed a beauty of a brief in support of his preliminary objectoins in his litigation with Daron...............without a lawyer.

In local news, Sam Patilla won his court case after bending over for the judge, spreading his ass cheeks, grabbing his ankles, and taking justice hard and dry up the ass.

A fine of 1000 dollars which is for ARD. Also probation for three months if he calls that a victory I hate to see what he calls a win. the only way he would of had one his case was very simple a jury would have said Not Guilty. AS we said all along what an IDIOT.

Well I guess if you look at it in this way he is free of all "charges" ... he plead out so one usually pleads to a lesser charge ... so technically ... he is free of all charges. He more than likely was not charged with the offense that he plead out to ... think about it. However that does not mean that he won.

According to what I've read, that isn't exactly true. Patilla accepted a plea agreement. He will serve three months on "unsupervised probation". He also has to complete the Accelerated Rehabilitative Disposition or "ARD" program.

While this is a minor sentence, it isn't without conditions. Most probation comes with restrictions such as not being allowed to consume alcohol, not fraternizing with known criminals, and most importantly, not getting arrested or cited again for the period of probation. It shouldn't be too difficult to comply with conditions in this case.

Finally, ARD isn't without cost. I believe it's in the neighborhood of $800.00, which will be added to the cost of prosecution. Even if there was no fine imposed (as in this case) a person accepting a plea is still responsible to pay court costs.

For Patilla, it is a victory of sorts, but it will ultimately still cost him money.

Well, being freed and making a plea deal are kind of different. It did seem odd that the court would just dismiss the charges. I'm hoping that this is what Sam wanted.

According to today's paper Mr. Pitilla did plea to a criminal charge which requires probation!!! So basically he did say to the courts that he is guilty of the charges!!

I don't believe an innocent man will ever take a plea agreement!

What lawyer has ever told a clearly innocent client to plea to a lesser charge? Especially in a disorderly conduct case. That would be the worst lawyering in the history of lawyering, Pilchesky era included.

If Sam were really innocent, as he was claiming from the beginning, there's no way in hell that he would have pled out. He flinched big time, and embarassed himself and Joe in the process. Good for them both. At least we won't have to hear from Rasta boy any time soon. Dumbass might have to chill for a while, huh?
