Ok Fay ... you asked a question ... about Sherri Fanuccis ability to keep her job and finish her term on Council ... Well Fay ... you need someone else to look it up for you ... but I thought that I would help you out ...

Ok Fay I'll tell you the steps which are pretty easy .... google the hatch act ... do you have that ... then click on it ... and when you get there ... well it will give you any information you want on Public employees in Politics ... it's an amazing thing that google. Because the Hatch Act does not prohibit a covered employee from holding public office, the state employee would be allowed to finish out his elected term despite the fact that he works in connection with a federally funded program. However, while he remains an employee working inconnection with a federally funded program, he would be prohibited from becoming a candidate in a partisan election. Candidacy for purposes of the Hatch Act has been interpreted to extend not merely to the formal announcement of candidacy but also to the preliminaries leading to such announcement and to canvassing or soliciting support or doing or permitting to be done any act in furtherance of candidacy. As the statute has been interpreted to prohibit preliminary activities regarding candidacy, any action which can reasonably be construed as evidence that an individual is seeking support for or undertaking an initial campaign to secure nomination or election to office would be viewed as candidacy for purposes of 5 U.S.C. 1502(a)(3). Consequent1y, the employee would need to leave his covered state position prior to beginning his candidacy.


Now Fay ... I got you this far ... I think that you can do it on your own to find out if Sherry can run again ... but she sure can serve the rest of her term.

Oh and by the way Robert Osborne ... he was not removed ... he was not eligible to run again but he served for the period in which he was elected. Get it straight!

and if you read the hatch act you will find out that ... they cannot be canidate in a partisan election ... but can however be appointed to fill a vacancy ... they just cannot run for the office.

Not to mention a portion of our State and Federal taxesgo towards supporting her wages as well.
