I have a question.If Mr. Hartman now has a job with a governmental agency, which I'm sure receives federal funding, how does this affect his elected position on the School Board?Is this not going to be a conflict with the Hatch Act??Or does the Hatch Act only affect Police & Fire Fighters?It seems that way since we have a council person who works in a congressman's office and nobody says a word.I'm still confused why teachers can sit on council, since schools receive federal funding, but police and fire fighters can't sit on school boards.Mr Pat O'Malley works a county job, which also gets federal funds,and yet can run for school board.Really seems like a double standard to me.Or am I wrong?
Ok since you are asking you are wrong ... Is Todd's salary coming from federal funds? Is he in control of Federal Funds? ... these are questions that need to be asked before jumping to the conclusion that he falls under the Hatch Act.
Just because the money comes from the taxpayers does not mean that it is automatically a position that falls under the Hatch Act.
The Hatch Actapplies by extension to certain employees of state and local governments whose positions are primarily paid for by federal funds.
As to Teachers sitting on Council ... well they do not control Federal Funds ... they are not usually paid by Federal Funds ... although some are it depends on the program ... for instance the Reading Specialists are paid through Federal Funds and a few others but for the most part Teachers (Janet Evans and Judy Gatelli) are not paid through Federal Funds ... although they may have equipment that is ... but they do not get their salaryfrom Federal Funding ... Even if Hartman's position was covered under the hatch Act, most civil service jobs do allow an employee to serve on a school board, but not in federal, state, county, or municipal government offices.
