Glenn I am posing this question to you for more than one reason ... A. because you are an attorney and I am assuming you will know the answer ... and B. because I want to know how it makes an attorney feel when Joe does this.
Is it legal for Joe Pilchesky to be offering his services to people who are in need of legal help? I am thinking that since he does not have a liscense to practice law that it would not be legal to make his services available to the general public. And what recourse does someone have in order to stop this man from doing this. I would think that the attorneys in the area might want to make an example of Joe as his is taking away from their livlihood ....
Here is an example of one post ... but if you take a trip around DD you will see where Joe has made this offer to many people.
Looks like Gatelli can still bring it. It was a small war at the zoning board meeting last night when Gatelli and the church went toe-to-toe. The church was already granted zoning approval but Gatelli and her neighborhood association appealed.
Good old Gatelli must be well rested. She was full of energy and plenty of hot air, too. She claims the place is a "hall", and not a church. Apparently, her argument was very convincing because the board changed its mind.
It sure looks like a church to me.

I've heard you can't afford the appeal. Sometimes, you don't need money, you just need the right friend. Call me even if you can afford the lawyer. More lawyers than not will sell you out. You may have already been sold out. Happens all the time in this county.

One cannot offer legal advice when one is not an actively-licensed attorney, even for free. Can somebody write up a contract on their own? Sure. Can somebody explain a legal term (life estate) in a deed? Most likely.
It's like the famous "porn" comment. When someone is engaged in the unauthorized practice of law, you will know it when you see it. I remember being in a creditors' hearing and watching the trustee rip somebody to shreds when they admitted receiving assistance from their friend who was a legal secretary. The firm got sanctioned and the secretary was fired.
I have a feeling that Joe has researched this matter and knows the fine line. The trouble is that fine lines are not always clearly seen.
I think that on more than one occassion he has crossed over that fine line ... in the past with Sam Patilla and Daniel Hubbard and most recently with this Pentacostal Church. He is offering his services and making statements that he is more reliable than local lawyers ... if you see the post above he is making the statement that local lawyers will "sell them out" ... that sounds to me like he has crossed that line.

Along the same lines, we have stuff like this from Pilchesky all the time...
"I've approached another party who I believed would want to help save this park. I made the same request for money to help with the furtherance of this marathon legal battle. He couldn't get his checkbook out fast enough. " The original thread can be linked here.
My question is this: how can this guy actively solicit money for others and not have it be a form of income that he would need to report? As far as a I know he doesn't operate a charity or other public service organization, so how does anyone know that any money given to him doesn't go to, say, the "keep Edith out of the pokey" fund?
