SCRANTON - A Commonwealth Court judge upheld a Lackawanna County Court decision denying a Scranton resident's petition claiming the Nay Aug Park pool house was constructed in violation of building codes.

Judge Mary Hannah Leavitt filed her opinion Thursday in the case involving Joseph Pilchesky, who had filed the complaint against the city and Mayor Chris Doherty in August 2007. In November of that year, a county judge dismissed the complaint. Mr. Pilchesky appealed in January, but Judge Leavitt ruled that Mr. Pilchesky could not challenge a court order more than a year after it was entered.
