My wife's guilty verdict. Another gift from us to you, a story we can now share......... We've learned a great deal since getting involved in the legal end of justice. More than one lawyer and/or judge has told us that law is a legal system, and not a justice system. We've lived through that often. On a local level, being Common Pleas Court, we've been pounded, but we've pounded back in Harrisburg. Judge Minora pounded us here over the golf course case, but we pounded him back in H'burg and got the case reinstated. Both Judges Minora and Munley pounded us here in the Cordaro case, and then we got pounded again by a crony Commonwealth Court judge named Kelly, but we loaded up and pounded them all back in the Supreme Court. Judge Mazzoni pounded us into oblivion in the Complex case, but we pounded him right back in H'burg and got the case reinstated. He abandoned the case. Judge Thomson stuck it up our asses over the ECTV case, but we stuck it right back up his ass in H'brug. The Court of Common Pleas is a dangerous place for anyone, to put it mildly. One case was initiated in Commonwealth Court, the Shimkus case, and that's where it ended, as did Shimkus' career.
In all of those cases, we always wanted our opponents in top shape. Top form. On their game and at full strength. We wouldn't have had it any other way. We never did anything to ambush or trick an opposing lawyer. Never tried to handicap them and never tried to mislead them.
We always knew we were never on our home court no matter where we were, so we understood the odds going in on every case. We're targets, and we know it. We knew the other side would lie, and lie and lie some more. But, we were always representing ourselves and one thing was sure, only we could screw ourselves, and not be screwed by any lawyer. The luxury of speaking for yourself is gone when you have to hire a lawyer. Placing trust in another displaces the confidence in yourself, and at that point, your flank is open.
Now, we have this criminal case of the AG against my wife in a county on the other side of the state, Erie County. Trial date: March 16, 2009. Certainly, very unfriendly territory. Our opponent, three special agents of the AG from two different offices, loaded with statewide resources coming out of their asses. The Common Pleas judge presiding over the case had dealt hundreds upon hundreds of times with the estate lawyer who was doing the screaming that Joanne overstepped her authority as power of attorney. They had tremendous home court advantage, and extraordinary state resources to prosecute. So, seriously, why couldn't they have been happy with that kind of an edge?
Well, they weren't. At least, someone wasn't.
They wanted much more of an edge. They wanted my wife to be unrepresented at trial. Ambush style.
They got it. How they got it I don't yet know, but they got it.
We had been preparing for 8 months to slam the AG to the canvass on everything from improper jurisdiction to unlawful convening of a grand jury to withholding evidence to wiping up their lying witnesses in the courtroom. We were ready. More than ready, we were loaded. In January, we took all of this comprehensive and masterfully constructed preparation to a lawyer we believed we could trust. We shared it with him. We dropped our pants. We explained the case to him. He understood it. Basically, he didn't have to do anythng but follow the yellow brick road. It was all laid out. We agreed on a price. We shook hands on the deal. He agreed to represent Joanne. We confirmed on March 6th over lunch that he'd be in Erie doing the storytelling, something he's quite good at. He said he was going on a brief vacation and to call him on March 10th, which we did. No response. No response on March 11th or 12th. Finally, a call on Friday, March 13th, at which time we reminded him of his critical role in this case, and that we had to get together to discuss travel plans, among other things. He said he'd get back to us. Then, he fell off the face of the earth. MIA. Come Monday morning, Joanne was on the business end of a decision by the judge that she was not going to do any talking on her own behalf, which she preferred to do. Two weeks earlier the judge decided out of the goodness of his heart to appoint a crony lawyer from the Public Defender's Office to do the talking for her because up to that point we had refused to disclose our lawyers name to the court, for good and obvious reasons. (Fix) Little did we know, it was already in.
The public defender the judge appointed knew we had private counsel, but didn't know who. We never communicated with him in that two weeks believing he'd never be in the courtroom anyway. When he found out that our lawyer pulled a Houdini, he asked the judge for a coninuance to prepare, but he was denied. The rest is stuff appeals are made of, and that's where we'll have to go to win this one, too. (Why should you get an appeal? You made a choice not to communicate with the lawyer that's your fault totally and maybe just maybe the judge had enough of you sill a$$ games! I think that if you were stupid enough to play it out this way then you should have to live with the consequences of you stupidity!)
If anyone happens to see Attorney Chris Cullen around, tell him the trial is over now. He can come out of hiding. The deed is done. It'll be undone under appeal, but for now, mission accomplished. One can't help but to wonder if having an office with Dave Rinaldi had anything to do with this incredible betrayal. Or, is it that he's Chris Doherty's first cousin? Maybe both? (What you didn't check him out before going to trial ... yeah I believe that! NOT!)What made Chris Cullen stab my wife in the back? Of all the people to betray, my wife. I hope it was the promise of money, a lot of money. He'll need every penny of it.

My condolences to you. Never have I heard of so much corruption in the legal system. You have managed to uncover the tiniest machinations in this corrupt judicial system and have reported it all to us. I thank you. Who would have believed that an attorney who had been retained for a trial would choose not to show up? And a judge would not grant a continuance so that the accused could have ample time to consult with her court appointed lawyer. It is disgusting. God bless you both with the strength to see this through, as we all know you will, and to be victorious.

He/She is kidding right ... they had ample time read the fVcking post Joe wrote ... he made a choice not to fill in the Court Appointed Lawyer ... it was his fault ... I think he wanted Edith to go to Jail ... this is just another example of Joe throwing his wife under the bus ... just like he did with the taxes ... man ... they ripped off the estate plain and simple ... now she will pay the price for her crime ... plain and simple ... Joe should take responsibility along with Joanne for his hand in they way this "game" played out ...

So the appeal to the Superior Court is "we had a secret lawyer, the old ace up our sleeve" who disappeared before the trial started.
I've never been on trial but is it normal for your "secret" lawyer to go on a small vacation right before your trial is to start?
On the question wasn't it Chris Cullen who was the lawyer who Convington Township hired and then a plea deal was miraculously reached when Joe was suing them? Is that conflict of interest?

It's gonna take pilcheski a little while to get enough conversations between his multiple personalities scripted and put out there to discredit the judge, the attorney, the mayor, the other attorney, the missus and the cab driver. Did I miss anyone?
Chris Cullen ... now if I'm not mistaken ... wasn't he Kevin Murphy's lawyer throughout his campaign??? Maybe Murphy told Cullen to back off of the case so he would not have to suffer the embarassment of having his lawyer associated with the likes of the Pilchesky's. The Plot thickens!
