Company sues critic for slander.

So Dan the loudmouth finally got a lawsuit handed to him. I gotta say, the only thing that suprises me is that it took this long. Dude's been flinging poo for a long, long time.

Not a legal mind like our buddy Pilchesky, I think what really pushed Daron over the edge was this baseless accusation: "June 21: Daron "is operating illegally, polluting the environment, killing residents." (emphasis mine)

Killing residents, huh? Surely he has undeniable proof that at least one resident passed away as a direct result of Daron's actions. Maybe an otherwise healthy and spry 89 year old woman just up and died from air pollution. Hell, I'm sure he has the preserved carcass of a squirrel who lived in the tree across the street that was run over by a member of the janitorial staff. (FYI, Danny-boy. They might be contracted vendors, with nothing at all to do with Daron, other than emptying garbages and mopping the piss off the floor in the mens room. Unless they're one of the illegal immigrants overrunning our city. Then we should hang 'em by the balls. I digress.) Certainly, Chief Medical Examiner Joe "I <3 Quincy" Pilchesky will provide all the legal expertise Dan the Man could possibly need, pro bono.

Or, he'll lose the family homestead in the deal and finally realize that with Freedom of Speech comes responsibility,a lesson that has yet to be learned among the regular speakers at council and the minions at DD.

Good luck, Dan. I hope the judge puts you on a payment plan. Enjoy playing the martyr until you actually do get nailed to the cross, big boy.

I guess you just can't mouth off and accuse people or companies of crimes without proof. Huh. Who'd have thought that type of behavior would have ended in a lawsuit.

Here's the over/under - the number of votes Hubbard got vs. the same number but in thousands that Daron will be awarded.

He got , what, like 60 votes? The over/under on the lawsuit would be $60,000. I'll take the over.

1. Dan Hubbard pays nothing.
2. Daron answers some of the less-invasive questions about its business practices and their effect on the environment.
3. Dan Hubbard tones down the rhetoric and asks better questions.

It seems the out-spoken, and well-spoken, Daniel Hubbard looks too much like a possible candidate for the 09 council seat up for grabs. No time like the present to try to get Dan to put his tail between his legs and see if he'll run. We'll all know soon enough. Dans' been a staple at council meetings for quite some time now.

Or, is it that Dan has issues with McGoff? Are they trying to keep him away from the podium as McGoff seeks to retain his rubberstamper seat? Looks that way to me. Dan's too strong of a speaker for the machine. But, right now, is his spine as strong as his voice. They're usually a perfect match. See Pilchesky vs. Entire Political Machine.

Will this action by Daron be a big mistake by the machine? My crystal ball sees poor judgment on Daron's part, and a lot of it. My crystal ball also sees Hubbard and Pilchesky enjoying some midnight oil burning on this. Maybe Pilchesky was involved behind the scenes since Hubbard started speaking about Daron at council meetings and Hubbard's words were meant to provoke the lawsuit. If that's the case, the fish has taken the bait. I think Daron should have been listening to the Doherty campaign's slogan, "Don't take the bait". Too late now. I love it.

Hubbard's grandchildren will love the story he tells of how his political career started. Daron will introduce Dan Hubbard to the world of judicial benefits and knowledge, which Hubbard will use over and over for the rest of his life. Hubbard's innate intellect has often teased council chambers during spontaneous banter with different councilpersons. They (the machine) should have recognized it for what it was. It was hardly concealed. They misjudged this book big time. Hubbard's ethical waters run deep. He's a very sincere person with an attraction to loyalty, but has that Pit Bull quality to him when he's rubbed the wrong way. He's a political diamond in the rough that was just brought to the surface by Daron. Was Daron baited? Well, that's not an issue for discussion at this point. Hubbard will cut his judicial teeth at Daron's expense. Whatever Daron's intent was, this move is classic sloppy play by the machine, predictably sloppy.

It's a matter of knowing how to make the dog's tail wag. No matter how big the dog is, there's always a way to make it wag. Watch where this goes.

If HUBBARD is smart:
  1. He will get a good lawyer so that he doesn't have to pay anything...to Daron that it...what he may have to pay for the good lawyer is a different story.
  2. He will agree to stop making outrageous claims like he invented the question mark (sorry...that was Pilchesky...no...Dr Evil...I get them all confused); scratch that...Seriously, he will stop making outrageous claims such as that Daron is killing people. Unless he can provide medical evidence...and Ozzie Quinn ranting about some person at the hospital doesn't fall into that category...he should keep the claims reasonable.
  3. He will keep his facts and his demands simple and to the point.
More than anything else, Hubbard needs to realize that some people in this world actually do fight back. It's as if he sees serial-plaintiff Pilchesky's constant bullying and thinks somehow that's a tactic worth emmulating. He's now realizing that unlike public sector people (who almost have to take a certain amount of bullying as part of the game), those of us in the private sector don't. Now I'm claiming that Daron is innocent in all of this...I don't know the facts at hand...but I do know that inflammatory rhetoric plays well on internet message boards, channel 16 thirty second news clips and that's about it.

Pilcheski's right -- they'll let Hubbard blather on and on, dig himself a deeper hole until he gets himself thrown in jail for a few years. I hear prisoners all thru the U.S. have a whole slew of legal books at their disposal.

An attorney's job (believe it or not) is to discourage litigation. I would never have recommended suing Mr. Hubbard unless I was willing to risk a lot of private information being made public, and that is something I cannot advocate for a business, especially in this county.

The company will lose this case.

Hubbard was a harmless loudmouth until he went on TV and to the newspaper. Now that he's chosen that route he'll have to stand behind his comments.

I really don't think Daron is worried about what will come out in court or they wouldn't have chosen this route. Surely the attorneys for Daron discussed this before filing suit. Mr. Hubbard can hope for a wrist slap from Daron at best, but even if he doesn't lose any money he loses what he wanted - Daron out of his neighborhood or to change the way they do business. By spouting off he took himself out of play.

Mark my words, this is just the beginning - more suits against the Legion of Doom are coming. Joe taught them how to not play nice. Not everyone is Chris Doherty. Some people won't ignore you. Sooner or later you screw with the wrong people. Hubbard is learning that now.

Two quick thoughts while I check something over a late lunch...

1. Glenn, Daron may loose in court, but Hubbard looses regardless of the outcome. If he really is being sued by the Daron folks, then he really should get an attorney, as a smart lawyer will make this difficult for Daron (precisely for the reasons you mentioned). This , however, will cost Hubbard some money out of pocket. I'd be shocked if he has that kind of change. If he goes it alone, well how does that old saying go..."he who acts as his own attorney has a fool for a client"?

2..Art hit the nail on the head...Hubbard & the DD crew don't realize that the rules of engagement with Daron are different than they are with Chris Doherty. Rule #1 - Know your enemy.

I agree that the lawsuit is simply a way to bring Mr. Hubbard to a proverbial screeching ass halt, and believe that when the folks at Daron are satisfied they have accomplished their goal they will "settle" the whole matter. My concern (if I were Daron) would be that someone else who CAN properly phrase the risky questions suddenly materializes as a result.

I would have contacted Mr. Hubbard before proceeding with legal action. This is as risky for Daron as it is for Mr. Hubbard. In any event, perhaps in the future Mr. Hubbard will sand off the rough edges of his oratory before presenting it in the public forum.

I disagree. Had they contacted Hubbard they would have read all about the contact in a post titled "Now the man is harassing me at home and threatening me" thread at dd.com.

They knew that going in and were smart to make Hubbard invest in his mouth.

As far as the times goes...I'll bet a MILLION dollars that Hubbard called them and said what time to be there. Free foot rubs, car washes, dog walks, lawn mowing AND oral sex to anyone (man or beast) who can prove differently.

No way they just happened to show up while he was there. No way in hell.
